New York prosecutors drop one sexual assault charge against Harvey Weinstein

Jackson Lee/GC Images(NEW YORK) — The criminal case against Harvey Weinstein sustained a blow Thursday when prosecutors with the Manhattan District Attorney’s office dropped one of the charges against the disgraced film producer.

Prosecutor Joan Illuzzi-Orban told the court she would drop count six of the indictment that involves Lucia Evans, the actress who accused Weinstein of forcing her to perform oral sex in 2004.

Prosecutors disclosed in a sealed September 12 letter to the defense that they discovered a written account from Evans that suggested the encounter was consensual.

Weinstein defense attorney Benjamin Brafman accused Evans of committing perjury when she testified to the grand jury. “Sexual assault is a serious crime but falsely accusing someone of sexual assault is also a serious crime,” Brafman said outside court Thursday.

Brafman said prosecutors discovered Evans’ written account about her encounter with Weinstein from a fact checker with The New Yorker and he said he would subpoena the magazine.

Weinstein’s defense team called the case “permanently and irreparably damaged” and said he would use the development to dismiss the whole case.

The defense said it would also subpoena police interview records after he said an NYPD detective “may have unfairly tainted these proceedings” when he prepared Evans for her testimony.

The detective has been removed from the case, Brafman said.

Evans’ attorney Carrie Goldberg said in a statement, “Let me be clear: the decision to throw away my client’s sexual assault charges says nothing about Weinstein’s guilt or innocence. Nor does it reflect on Lucia’s consistent allegation that she was sexually assaulted with force by Harvey Weinstein. It only speaks volumes about the Manhattan DA’s office and its mishandling of my client’s case.”

Hurricane Michael ripped through Florida Panhandle 'like a freight train,' says resident who weathered storm

ABC News(PANAMA CITY, Fla.) — Like thousands of other people across the Florida Panhandle, Krista Miller was urged to evacuate her home in Apalachicola before Hurricane Michael roared ashore.

But Miller chose to stay behind and weather the dangerous storm in her two-story, 111-year-old house, which is just 100 yards from the Apalachicola Bay coastline.

“When the storm came through, you could literally feel the power,” Miller told ABC News’ Chief Anchor George Stephanopoulos via FaceTime Thursday in an interview with Good Morning America.

“It sounded like a freight train coming from every direction,” she added. “It was pretty terrifying.”

Michael made landfall in the Florida Panhandle near Mexico Beach and Panama City on Wednesday afternoon as a Category 4 hurricane with whopping 155 mph winds, making it just short of a Category 5, the strongest on the Saffir-Simpson hurricane wind scale.

It was the worst storm to hit the region since the mid-1800s and the first Category 4 hurricane to ever come ashore there on record. Florida Gov. Rick Scott described the storm as “monstrous.”

At least one person has died in Florida from the storm, according to local officials.

Another storm-related death was confirmed in neighboring Georgia. An 11-year-old girl was killed when part of a metal carport crashed into her family’s trailer in Lake Seminole and struck her in the head, local officials said.

Miller comes from a long line of fishermen on St. George Island off the coast of the Florida Panhandle. She now runs a fishing charter business, and said the hurricane was a Category 2 when she decided not to heed a mandatory evacuation order for her county earlier this week. By Wednesday morning, the storm had rapidly intensified but it was already too late to evacuate.

“I stayed because my parents didn’t want to leave. My father is responsible for all of the seafood that’s in our area, literally millions and millions of dollars of seafood, and he feels compelled to stay to make sure those seafood houses are back up and running as soon as the storm passes,” she said. “I didn’t want to leave them and I felt that I needed to be here.”

Miller and her elderly parents hunkered down inside her home in Apalachicola’s historic district. She said she feels “truly blessed” that her house “withstood the power” of the hurricane, although the neighborhood was hit hard and some parts were submerged in floodwater.

“There’s trees down here in every direction. We’re going to be out of running water pretty shortly, I’m sure,” she said.

Kelsea Ballerini says her "adrenaline-heavy" video with The Chainsmokers is like nothing she's done before

ABC/Image Group LAWhen the expanded edition of Kelsea Ballerini‘s sophomore album comes out October 26, it’ll include “This Feeling,” her new collaboration with The Chainsmokers.

Kelsea admits she’d been dreaming of working with the electronic duo for some time, even performing their monster hit from 2016 on tour.

“I met the guys two years ago at the Grammys,” she recalls. “I covered ‘Closer’ all during the tour, and just kept saying that my favorite collaboration that I wanted to do was The Chainsmokers.”

“And then finally, they were, I think, probably just like, ‘I’m tired of her harassing me,'” she laughs.

Ultimately, their track together ended up fitting perfectly with Kelsea’s Unapologetically album.

“I love the song,” she tells ABC Radio. “I mean, ‘This Feeling’ is all about following your heart, which is the whole album that I made, that’s what it’s about, so it really made sense, and we’re friends.”

Up next, Kelsea’s fans can look forward to the most daring music video she’s ever made.

“We’ve already shot the video. It comes out, I think very soon,” she explains. “It’s definitely a very adrenaline-heavy video. I’ve never done anything like it, so I’m excited.”

Kelsea’s third single from Unapologetically, “Miss Me More,” is currently climbing the country chart.
